3. NO DUTY TO VET OR MONITOR PROVIDERS
You acknowledge and agree:
- We are not responsible for screening, vetting, licensing verification, or monitoring providers.
- Inclusion on the Platform does not constitute endorsement.
- Rankings do not reflect qualification guarantees.
- We do not conduct background checks unless explicitly stated.
You are solely responsible for:
- Verifying licenses
- Verifying insurance
- Conducting interviews
- Reviewing contracts
- Inspecting completed work
4. RANKINGS, SCORES & METHODOLOGY DISCLAIMER
Rankings, scores, badges, and placement may be influenced by:
- Internal algorithms
- Publicly available data
- Review volume
- Engagement signals
- Commercial relationships
- Advertising agreements
- Lead purchase history
- Provider responsiveness
We reserve the absolute right to:
- Modify methodology at any time
- Change rankings
- Add/remove providers
- Adjust scoring models
- Display sponsored placements
Rankings are opinions, not factual guarantees.
5. AFFILIATE & PAID PLACEMENT DISCLOSURE
Home Rank may receive compensation from:

- Affiliate relationships
- Sponsored listings
- Advertising contracts
- Performance-based agreements
Compensation may affect:

- Placement
- Ordering
- Prominence
We are not obligated to disclose exact compensation structures.
6. LEAD SUBMISSION & COMMUNICATION CONSENT (TCPA PROTECTION)
By submitting information:
You expressly consent to:
- Phone calls (manual or automated)
- SMS messages
- Prerecorded voice messages
- Email communication
From:
- Home Rank
- Partner providers
- Advertising partners
- Lead buyers
Consent is not a condition of purchase.
You waive claims under:
- TCPA
- Do-Not-Call claims
- Automated dialing restrictions
Where permitted by law.
You agree to indemnify Home Rank for false information submissions.
7. NO GUARANTEE OF LEAD QUALITY (PROVIDER PROTECTION)
If you are a service provider:
You acknowledge:
- Leads are not guaranteed to convert.
- We do not guarantee exclusivity.
- Leads may be shared with multiple providers.
- Consumer intent cannot be guaranteed.
- Contact information may be inaccurate.
You agree:
- No refunds unless explicitly agreed in writing.
- Disputes do not suspend payment obligations.
- Chargebacks may result in account suspension.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
Home Rank shall not be liable for:
- Direct damages
- Indirect damages
- Consequential damages
- Lost profits
- Business interruption
- Data loss
- Property damage
- Personal injury
- Emotional distress
- Provider misconduct
- Contract disputes
Total liability shall not exceed $100 USD.
9. CLASS ACTION WAIVER

- All disputes shall be resolved individually.
- No class actions.
- No collective proceedings.
- No representative lawsuits.
10. ARBITRATION AGREEMENT
All disputes shall be resolved by binding arbitration under the Federal Arbitration Act.

11. FORCE MAJEURE
Home Rank shall not be liable for failure to perform due to:

- Internet outages
- Hosting failures
- Government actions
- Regulatory changes
- War
- Labor strikes
- Platform provider shutdowns
12. INTELLECTUAL PROPERTY & SCRAPING PROHIBITION
All content including:
- Rankings
- Scores
- Layouts
- Databases
- Lead systems
- Methodologies
Are protected intellectual property.
You may not:
- Scrape
- Crawl
- Copy
- Reverse engineer
- Extract data
- Use bots
- Use automated tools
Violation may result in:
- $5,000 per violation liquidated damages
- Injunctive relief
- Legal fees
13. LIQUIDATED DAMAGES
If you:
- Scrape data
- Manipulate rankings
- Submit fake leads
- Circumvent payment systems
You agree to pay:
- $5,000 per violation
- Plus attorney fees
- Plus injunctive relief
14. DISCLAIMER OF WARRANTIES
The Platform is provided “AS IS” and “AS AVAILABLE.”
We disclaim:
- Merchantability
- Fitness for purpose
- Accuracy
- Uptime guarantees
- Non-infringement
- Error-free operation
15. ADA & ACCESSIBILITY DISCLAIMER

If any provision is invalid, remaining provisions survive.
